This document sets out the general conditions of the contractual relationship for the sale of products offered through this website, owned by SUSMIE'S COLLECTION, SL (hereinafter, "SUSMIE'S COLLECTION"), with registered office at Ronda General Mitre, 126, Postal Code: 08021, City: Barcelona, with Tax ID (NIF): B-16974180, and the natural persons (hereinafter, "CUSTOMER") who express their intention to purchase the products through the request made via the Internet on this Website. 


These user requests constitute the particular conditions to which these general conditions are linked, which the CUSTOMER must necessarily accept electronically prior to the purchase of the product. The CUSTOMER is shown these conditions through this same Website, so that they may read, print, file and accept them. The CUSTOMER may consult these general conditions at any time through the Website.

 

FIRST.- PURPOSE OF THE CONTRACT.- 

By means of these General Conditions, SUSMIE'S COLLECTION undertakes to deliver to the CUSTOMER the products that the latter has requested through the Website in exchange for a certain price. 

By purchasing the products available on this Website, the CUSTOMER declares that:

  1. He/she is of legal age and has the capacity to enter into a contract.

  2. He/she has read, understood and accepts these General Terms of Contracting.


SECOND.- AMENDMENT OF THE GENERAL CONDITIONS.- 

SUSMIE'S COLLECTION reserves the right to modify these General Conditions at any time, without the need to notify the CUSTOMER in advance, who in any case is responsible for reviewing them as a prerequisite for the acquisition of any product available through this Website. In any case, the General Conditions displayed on the Website at the time the CUSTOMER acquires the corresponding products shall be considered valid and applicable.


THIRD.- RIGHTS AND OBLIGATIONS OF SUSMIE'S COLLECTION.-

3.1. Liability of SUSMIE'S COLLECTION. Under no circumstances shall it be liable in relation to:

3.1.1. Errors, delays in access on the part of the CUSTOMER when entering their data in the order form, slowness or impossibility of receipt by the recipients of the order confirmation or any anomaly that may arise when these incidents are due to problems on the Internet network, fortuitous events or force majeure and any other unforeseeable contingency beyond the good faith of the company. In any case, SUSMIE'S COLLECTION undertakes to resolve any problems that may arise and to offer all necessary support to the CUSTOMER in order to reach a quick and satisfactory solution to the incident.

3.1.2. Errors and damages produced by inefficient and bad-faith use of the product by the CUSTOMER. 

3.1.3. The non-operability or problems with the email address or telephone number provided by the CUSTOMER for sending the order confirmation.

3.2. We reserve the right to modify the prices and availability of the products at any time without prior notice. We strive to accurately display the colours and details of the products in the images, but we do not guarantee that the display on your device will accurately reflect the colours.

3.3. Shipping and Delivery: delivery times may vary depending on the location and other external factors. Delays due to customs processes or inspections are beyond our control and do not entitle the customer to a return or refund. We are not responsible for delays or delivery failures caused by circumstances beyond our control. 

3.4. International Shipping and Customs: International shipping and customs; shipments outside the European Union may be subject to import fees, duties or taxes, which are not included in the price or shipping costs. These costs shall be the sole responsibility of the buyer and shall not be refunded if the package is rejected or abandoned for this reason.

3.5. Right of Withdrawal:

SUSMIE'S COLLECTION recognises the CUSTOMER's right of withdrawal under the terms and within the time limits established in Royal Legislative Decree 1/2007 of 16 November. In this case, SUSMIE'S COLLECTION shall refund to the CUSTOMER the amount paid for the price and applicable taxes to the account number indicated by the CUSTOMER. The CUSTOMER has a period of 14 days to exercise this right, counted from the purchase of the product, considering as such date, unless proven otherwise, the one indicated in the CUSTOMER's email confirming the transaction. In order to exercise this right, the CUSTOMER must send an email to orders@susmies.com and notify SUSMIE'S COLLECTION within the time limits provided.


FOURTH.- RIGHTS AND OBLIGATIONS OF THE CUSTOMER.-

4.1. Account Registration: In order to make purchases through our website, it is necessary to create a personal account. You must provide truthful, up-to-date and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur on your account.

4.2. Payment: By making a purchase through our website, you agree to provide valid payment information and authorise the corresponding charge. Responsibility for the accuracy of the shipping data lies exclusively with the buyer. 

4.3. We reserve the right to reject or cancel orders for any reason, including product availability, errors in prices or descriptions, or breach of these General Terms of Purchase. The CUSTOMER undertakes to pay in advance the amount for the product effectively requested in the amount and form as follows:

4.3.1. Amount: The price for the product effectively requested by the CUSTOMER shall be that indicated on the Website and that appears in the specific request of the CUSTOMER at each moment, a request which shall constitute the particular conditions of the specific order. The prices of the products that appear on the Website include VAT.

4.3.2. Methods of Payment.- The CUSTOMER must pay the amount corresponding to their order by:

- Credit or debit card (VISA OR MASTERCARD): by entering their data in the virtual POS available on the Website. By accepting this method of payment, the CUSTOMER confirms that they are authorised to use the card used for this purpose, being the holder thereof. Card payments are subject to the provisions of Law 16/2009 of 13 November on payment services, especially with regard to payment orders and the conditions for their revocation.

- PayPal: for which the CUSTOMER declares to have an active account with said payment service provider, accepting the conditions of said service.


FIFTH.- RETURN AND REFUND POLICY.-

If the CUSTOMER is not satisfied with their purchase, they may return the item(s) provided that the following conditions are met: 

  1. We will not process returns that have exceeded a period of 30 days from the date of delivery. 

  2. Returned items must be unused and in the same condition in which you received them. 

  3. The refund will be processed once we have received and inspected the returned item at our warehouse. The processing time may vary.

Due to the emissions generated by national and international transport, making a return has a fixed shipping cost. This will vary depending on the country from which the return is issued. This will be deducted from the total amount of the refund to the customer.

  • Spain: 5€. 

  • EU 1: 10€ (Germany, France, Italy and Belgium) 

  • EU 2: 15€ (Rest) 

  • Rest of the World: 25€. 

The refund of your purchase will be transferred by these two options: To the same card with which you placed the order, or by bank transfer. You have a maximum period of 30 days to request the return from the day you receive the order, and it will only be possible if the purchased product is in perfect condition.

Import duties outside the European Union

In some cases, shipments to countries outside the European Union may be subject to import fees, duties or taxes, established by the customs authorities of the country of destination. These additional costs are not included in the price of the product or in the shipping costs, and shall be borne by the buyer.

The amount and conditions of such fees depend on the regulations in force in each country, so we recommend consulting the local customs office before placing the order.

In the event that the buyer decides not to assume the customs costs and rejects the package, the shipment will be held in customs (according to the regulations of the country of destination). The package will be declared lost and it will not be possible to make the return or refund.

Gift Card

There is the possibility of returning your online purchase and receiving a gift card by email for the value of your product, without paying the return costs. This card does not expire and you can use it to purchase any product on our website for the same value.

 

SIXTH.- LIABILITY.-

6.1.- SUSMIE'S COLLECTION shall under no circumstances be liable for:

6.1.1 The production of any type of damage that the CUSTOMER or third parties may cause to the Website.

6.1.2.- SUSMIE'S COLLECTION reserves the right to suspend access without prior notice at its discretion and on a definitive or temporary basis until the effective responsibility for any damage that may occur is ascertained. Likewise, SUSMIE'S COLLECTION shall cooperate with and notify the competent authority of these incidents as soon as it has reliable knowledge that the damage caused constitutes any type of unlawful activity.


SEVENTH.- MODIFICATIONS.- 

We reserve the right to modify these Terms of Service at any time. Any changes will be effective from the moment of their publication on the website. Any modification will only apply to orders placed after the date of publication; orders placed previously will be governed by the terms in force at the time of purchase. It is your responsibility to periodically review these terms in order to keep up to date with any updates.



EIGHTH.- ELECTRONIC INVOICE.-

The CUSTOMER expressly accepts the sending of electronic invoices in relation to purchases made at SUSMIE'S COLLECTION. The invoice will be sent to the email address provided by the CUSTOMER during the registration process.

Should you wish to receive the invoice on paper, you must inform us through the following email address susmiescollection@gmail.com. 



NINTH.- COMPETENT JURISDICTION AND APPLICABLE LAW.- 

These general conditions are governed by Spanish law. For the determination of the place of conclusion of the sale to which these General Conditions are subject, the provisions of Article 29 of Law 34/2002, of 11 July, on information society services and electronic commerce, shall apply. In the event that the CUSTOMER does not have the status of consumer, any conflict relating to the interpretation or execution of these General Terms of Contracting shall be submitted to the jurisdiction of the Courts of the city of Barcelona.


TENTH.- NULLITY OF CLAUSES.-

In the event that any clause of these General Conditions is declared null and void, the other clauses shall remain in force and shall be interpreted taking into account the will of the parties and the very purpose of these conditions. SUSMIE'S COLLECTION may refrain from exercising any of the rights and powers conferred on it in this document, which shall in no case imply a waiver thereof unless expressly recognised by SUSMIE'S COLLECTION.
